Changing Regime Matrimoniale

We would like to change our Regime Matrimoniale [we are shortly to buy a new house] and called one of the local avocats.

We were quoted a horrendous 1000 euros hors taxes. Surely this is excessive?

Would anyone who has done this recently please advise what they paid. TIA

Two years ago we paid 850 eur.

If it good for you both you have to pay.

The notaire we bought through did it for us a couple of years ago and cost about €250, from memory.

We also paid €250, to the same notaire who was in charge of our house purchase.  That was four and a half years ago.  Most people we know have done this through a notaire and not through an avocat - maybe it would be worth contacting a couple of local notaires, including the one who will be handling your house purchase ?

I believe (although I'm not sure of the authority for this) that in a case where the change might have an effect on the rights of heirs, e.g. where there are children from a previous marriage, the approval of the court may be necessary, and if this is so you will need an avocat to represent you.

On the other hand, it can certainly be done by a notaire if it's simple enough.  Logically the thing to do is to start with the notaire; he should be able to tell you whether it's within his competence. If it isn't, he shouldn't charge you very much for telling you.

Are you talking about changing it or declaring it as you do when initially purchasing ?

We opted for CU when we bought and paid nothing over and above the standard Notaires fee for the transaction.

 


My doctor said one drink per day, I can live with that !

We paid 300euro and it was completed at the same time for the house purchase 3yrs ago.

I think we paid 300€ after having already purchased, and also had to pay tax based on the increase in value since we first purchased. We got our notaire to sort out the change in regime.
